AGREEMENT FOR SERVICES

The following constitutes the Agreement for Services/Rentals (hereinafter, referred to as “Agreement”) between ____________________________  (hereinafter, referred to as “Client” and Magic Place USA, LLC., a Florida limited liability company (hereinafter, referred to as “Magic Place”). This Agreement shall be controlling in all transactions between Client and Magic Place. It is solely the Client’s responsibility to read andunderstand theforegoing Agreement, as it mayaffect your rightsunder this Agreement and Florida law.

Client wishes to engage the services of Magic Place for party services including props and equipment in Magic Place facility, to be used by Clients and its guests during the contracted time frame of the party (hereinafter, “Party Time”). Client hereby understands and acknowledges that the use of Magic Place’s equipment (hereinafter, “Equipment”) carries inherent risk to both Client and Client’s guests, and the use of this Equipment, by its very nature, may cause injury or harm to Client, Client, or its guests. By engaging in this transaction with Magic Place for the use ofthe Equipment, Client hereby agrees andacknowledges that it shall be bound by the terms of this Agreement.

CLIENT WAIVER AND RELEASE: Client understands and acknowledges that this Release is a legal document and Client hereby knowingly and willingly hereby discharges Magic Place from anyand all liability or claim that the Client may have against Magic Place for any bodily injury, personal injury, illness, death, property damage or economic injury that may result from Client’s use and possession of the Equipment. Client does hereby release and forever discharge and hold harmless Magic Place, its principals and managers, employees as well as its successors and assigns from any and all liability claims, and lawsuits of any kind or nature, either in law or in equity, which arise or may hereafter arise from Client’s possession and use of Equipment pursuant to this Agreement.

INSURANCE COVERAGE: Client understands that any and all insurance coverage for any bodily injury, personal injury, illness, death, property damage or economic injury in any way related to the use of any Equipment in our facility under this Agreement shall be the sole responsibility of the Client.

As a condition of this Agreement for use of the facility and Equipment during the Party Time, Client hereby agrees as follows:

MAGIC PLACE FACILITY

Magic Place is a NON-SMOKING facility. Client and Guests must refrain from smoking while inside the facility.

Magic Place does not allow or serve alcoholic beverages to anyone. Client can bring additional beverages such as fruit punch, however no bottles of any kind allowed, the beverage must be on a self-serve container for guests to serve themselves. IF THE CLIENT WISHES TO SERVE ALCOHOLIC BEVERAGES, IT MUST CONTRACT THE OUTSIDE SERVICES OF A PROFESSIONAL BARTENDER WHO WILL NEED TO PROVIDE A CERTIFICATE OF LIABILITY AND THE PROPER GOVERNMENT ALLOWED LICENSING. NO EXEPTIONS.

BABY SOFT PLAY GYM

The Baby Gym area is designed for children ages 1-3. Children must remove their shoes and always wear socks in the Baby Gym Area. Children with shoes on and/or without socks will not be allowed in the Baby Gym area. Parents should state on their invitations that all guests need to bring/wear socks).

BALL PIT

Balls are not to be thrown at others in the ball pit. Balls are not to be deliberately damaged or squashed or taken from the ball pit area. Balls are not to be thrown down the slides or outside the play area. Jumping on others in the ball pit is STRICTLY PROHIBITED. Before jumping, guests need to check and/or ask if anyone is hiding in the balls to make sure no participant is under their fall area.

BOUNCE HOUSE

Adults and Children 15 and older are not allowed to jump in the Bounce house.
No shoes allowed. Children must always wear socks while using the bounce house.
No diving.
No food, candy, gum, or beverages are allowed in bounce house.
No pets, toys or sharp instruments are allowed on the bounce house at any time.
No face-paint, party poppers or mess prone products (i.e., glitter, slime, messy art, temporary tattoos, etc…) are allowed on the bounce house.
All sharp objects must be removed before entering the bounce house.
Individuals with head, neck, back or other muscular-skeletal injuries or disabilities, pregnant women, small infants, and others who may be susceptible to injury from falls, bumps or bouncing are not permitted in the bounce house at any time.

THEME DESIGN AND PROPS

Theme design and props are the sole property of Magic Place.

DEPOSIT/RESERVATION: At time of booking, a non-refundable Fifty (50%) percent deposit of the total balance along with this executed Agreement shall be required to secure your requested Party Time. The remaining balance will be due Three (3) business days prior to your Party Time. Failure to pay the balance in full will result in cancellation of the event.

GUEST COUNT

Client agrees to abide by the number of guests allowed on the Magic Place Package paid for. Magic Place Packages have a guest count of 30 to 70 guest depending on the package chosen. ANY additional guests will be charged at a $15 per guest plus tax and service fee per guest.

ADDITIONAL HOURS

Additional Party Time hours are available upon request and Magic Place approval at a rate of $250 per hour.

CANCELLATIONS: Cancellations up to 2 weeks prior to your Party Time will be credited for a future reservation within Six (6) months of original Party Time and the design and theme of the party may not be changed. Any cancellations less than 2 weeks prior to your Party Time, other than those as a result of a natural disaster, are considered null and void and no part of payments will be refunded. Any cancellations
due to a hurricane or other natural disaster, will result in a full credit that may be used up to a year after your original booking date. will be credited for a future reservation within Six (6) months of original Party Time and the design and theme of the party may not be changed. 

COVID 19: IF YOU FEEL SICK OR HAVE BEEN EXPOSED TO ANYONE WITH COVID-19 OR ANY CONTAGIOUS DISEASE WITHIN THE PAST 2 WEEKS PRIOR TO THE RENTAL’S DATE, PLEASE CONTACT US TO POSTPONE YOUR EVENT.

ATTENDANT:

Magic Place Attendant’s sole responsibility shall be to ensure Equipment is used in a safe way and that Magic Place rules are strictly followed. CLIENT AND GUESTS, maintain the sole responsibility for the supervision of children on and around the Equipment during Client’s Party Time. Magic Place attendants are not responsible for supervising, babysitting, or monitoring the Client’s or guests’ children. Attendants do not have medical training, will not provide medical care or any first aid assistance. For the safety of the children, the attendant has the right to ask thatany Client or guests’ child / parent who is not following Magic Place’s safety protocols, exit the Equipment and the play area.

ASSUMPTION OF RISK: All Clients, invitees, and persons using Equipment do so at their own risk and Magic Place expressly denies any legal responsibility or liability for bodily injury, personal injury, illness, death, property damage or economic injury that may result from Client’s use of the Equipment.

SEVERABILITY: If the whole or any part of a provision of this Agreement is void, unenforceable or illegal in a jurisdiction or it is severed for purposes of that jurisdiction, the remainder of this Agreement shall remain in full force and effect and the validity or enforceability of that provision in any other jurisdiction shall not be affected. This clause has no effect if the severance alters the basic nature of this Agreement or is contrary to public policy.

INTEGRATION. This Agreement expresses the complete understanding of the Parties with respect to the subject matter and supersedes all prior proposals, agreements, representations, and understandings. This Agreement may not be amended except in a writing signed by both parties. Neither Party to this Agreement shall reveal to any third Party the contents of this Agreement nor the discussions described in this Agreement.

WAIVER. The failure to exercise any right provided in this Agreement shall not be a waiver of prior or subsequent rights.

ENTRY OF FOOD BY THE CLIENT OR VENDORS.________________________  releases Magic Place USA llC. and its staff from all liability for any damage that may be caused by food consumed within the facilities of Magic Place USA LLC.

PLACE USA LLC. 

ENTRY HOURS. On the day of the event, the client will be able to enter the facilities of Magic Place Usa LLC, 30 minutes before the event.

DEPARTURE TIME. The client and their guests must leave the Magic Place facilities at the end of the celebration hour.
Once the 30 minutes have elapsed, 1 extra hour ($250) will be charged.

MAGIC PLACE MAXIMUM CAPACITY.

Maximum capacity 80 people including guests (adults and children), staff magic place, vendors.

____________________________________, AFFIRM (S)_THAT CLIENT IS OVER THE AGE OF EIGTEEN AND LEGALLY CAPACITATED IN THE STATE OF FLORIDA. CLIENT FURTHER CERTIFIES THAT CLIENT HAS READ AND UNDERSTOOD THIS AGREEMENT. CLIENT ACKNOWLEDGES AND UNDERSTANDS THE CONTENT OF THIS AGREEMENT. THIS AGREEMENT CANNOT BE MODIFIED VERBALLY. CLIENT UNDERSTANDS THAT THIS AGREEMENT IS A RELEASE OF LIABILITY ON BEHALF OF MAGIC PLACE.

This Agreement may be executed in counterparts and/or by facsimile signature (“counterpart”), and when each party has signed and delivered at least one such counterpart, each counterpart shall be deemed an original, and, when taken together with other signed counterparts, shall constitute one Agreement, which shall be binding upon and effective as to all Parties.

VENDORS. The Client must notify by email, [email protected] if on the day ofhis celebration he has vendors who will enter the facilities of MAGIC PLACE USA LLC.

Magic Place has the power to allow vendors to enter, or not on the day of teh event. For each Vendor that enters the facilities of MAGIC PLACE USA LLC, you must send your LIABILITY by email, [email protected] This Agreement shall be governed by the laws of the State Florida.

FOOD. There will be a $150 cleaning fee for bringing food into Magic Place facilities (PLATES, PLATES, AND SILVERWARE NOT INCLUDED, THE CUSTOMER MUST BRING THEM) Magic Place has the discretion to allow or not allow vendors on the day of the event. For each Vendor entering MAGIC PLACE USA LLC facilities, you must send your.

LIQUOR. There will be a $150 cleaning fee for bringing wine and beer into Magic Place (COOLER, ICE AND GLASSES ARE NOT INCLUDED, AND THE GUEST WILL SERVE THEMSELVES).

Magic Place Usa LLC, includes for each celebration 6 white tables without decoration and 40 white chairs without decoration.
